No waiver by the Company of any term or condition set out in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held to be invalid or unenforceable, such provision shall be struck from the Terms and the remaining provisions shall be enforced. In our sole discretion, we may replace any invalid or unenforceable provision with a valid and enforceable provision which achieves, to the extent possible, the original objectives of the invalid or unenforceable provision.
